Section 38 Highways Act 1980
West Oxfordshire District Council acts as an Agent to Oxfordshire County Council to oversee the construction by developers of all new estate roads. This is to ensure that when they are completed, they can become adopted highways and be maintained by Oxfordshire County Council as the Highway Authority.
Whilst new estate road are being built the Council will monitor, inspect and test the roads to make sure they comply with the relevant provisions of the Highways Act 1980.
The developer maintains the roads on new estates for the first year following their completion after which they become adopted highways subject to any defects being put right.
Information for Developers
On payment of the appropriate fee the Council will ensure that:
- advice is given to achieve an acceptable technical submission;
- a site inspector is available to advise on site details and monitor construction;
- the administration of the adoption is overseen efficiently to avoid unnecessary delays.
