Unoccupied Property ReductionsIn some circumstances a property which is unoccupied but not necessarily unfurnished can be may be eligible for an exemption. These exemptions are described below. Occupant Detained in Prison If a property has been left unoccupied due to the occupier being detained in prison, hospital or other place of detention, this exemption can be awarded. When awarded, the exemption will apply to the property for the duration of the occupants stay in prison, hospital or elsewhere by order of a court. This exemption will not be granted were the occupants imprisonment is for non payment of Council Tax. Resident Now Lives in a Residential Home or Hospital Where a property has been left unoccupied because the occupier, who used it as their main residence, now lives in a residential home or hospital, this exemption can be awarded. The exemption will remain on the property for as long as the occupier is in the hospital or care home. Property Unoccupied Due To Death of Occupier In these cases an exemption can be applied to a property until probate is granted. After probate is granted a further 6 month exemption may be awarded. Occupation of Property is Prohibited Where occupancy of a property is prohibited by law or because of action taken by a public body an exemption can be awarded.
