Smokefree premises legislation

Nearly all indoor workplaces, work vehicles and public spaces in England have been smokefree since 1 July 2007. The smokefree legislation was introduced to protect employees and members of the public from the harmful effects of second-hand smoke.

We have adopted a light-touch approach to meeting the legislation and fines can be given for:

  • Smoking in a smokefree building or car - a fixed penalty notice of up to £50 or a fine up to £200
  • Failing to display correct smokefree signage - up to £1,000 fine
  • Failing to prevent smoking in a smokefree area - up to £2,500 fine
